The Internet enables innovation, collaboration, and global connectivity. Because shared infrastructure must be protected to serve everyone fairly, NuclearDynamics.com establishes Terms of Use that define responsible behavior, preserve performance, and uphold the law.

TERMS OF USE

These Terms of Use (“Terms”) govern access to and use of services provided by Lazo Consumer Products, LLC, doing business as Nuclear Dynamics (“Nuclear Dynamics,” “we,” “us,” or “our”).

By using our services, you agree to these Terms, the Acceptable Use Policy (“AUP”), and the Privacy Policy, each of which is incorporated by reference and forms a single binding agreement (collectively, the “Agreement”).

1. Company Information

2. Services

Nuclear Dynamics provides infrastructure services including, but not limited to, virtual private servers (VPS), networking, and related hosting services (“Services”).

All Services are provided “as-is” and “as-available.”

3. Payments, Billing & Subscriptions

3.1 Billing

Services are billed in advance on a recurring basis.


  • Core VPS promotional rate: $59.40/month for the first 12 months
  • Standard rate after promotion: $99/month


Failure to cancel prior to renewal constitutes acceptance of the renewal charge.

3.2 Chargebacks

Unresolved chargebacks or disputes through Stripe, PayPal, or other processors will result in:


  • Immediate service suspension
  • Data archival for 14 days
  • Permanent data deletion after archival


4. Service Level Agreement (SLA)

4.1 Uptime

We target 99.9% network uptime per calendar month, excluding:


  • Scheduled maintenance
  • Force majeure events
  • Customer-caused outages
  • AUP violations


4.2 Credits

Service credits (not cash refunds) may be requested within 7 days of the affected month:

5. Refund Policy

All payments are non-refundable, including promotional pricing, setup fees, migrations, and custom work, except where required by law.

Accounts terminated for violations of the Agreement are not eligible for refunds.

6. Data Responsibility

Customers are solely responsible for maintaining independent off-site backups. Nuclear Dynamics is not responsible for data loss, corruption, or deletion.

7. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into this Agreement by reference.

8. Limitation of Liability

To the maximum extent permitted by law, Nuclear Dynamics shall not be liable for:


  • Data loss
  • Lost profits
  • Business interruption
  • Indirect or consequential damages


Total liability shall not exceed the amount paid by the customer in the three (3) months preceding the claim.

9. Termination

We may suspend or terminate Services at our sole discretion for violations of this Agreement or applicable law.

10. Governing Law

This Agreement is governed by the laws of the State of New Mexico, USA.

ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy (“AUP”) is part of the Agreement governing use of Nuclear Dynamics services.

1. Prohibited Activities

1.1 Resource Abuse

Excessive or abusive use of CPU, RAM, disk I/O, or bandwidth that negatively impacts other customers (“noisy neighbor” behavior) is prohibited.

1.2 Prohibited Content

You may not host, transmit, or distribute:


  • Child sexual abuse material (CSAM)
  • Malware, ransomware, spyware, or exploit code
  • Phishing, fraud, or impersonation content


Confirmed violations result in immediate termination and may be reported to authorities.

1.3 Spam & Email Abuse

Sending unsolicited bulk email (SPAM) is prohibited.

All email must comply with:


  • The CAN-SPAM Act
  • Applicable international regulations


Accounts causing IP blacklisting will be terminated without refund.

1.4 Illegal or Malicious Activity

You may not use our Services for:


  • DDoS attacks
  • Unauthorized port scanning
  • Network intrusion or cracking
  • Circumventing security controls


2. Enforcement

Violations may result in throttling, suspension, termination, or reporting to authorities, at our discretion.
